Judge Grants Delay In Wife's Rape Case
Warren Man Accused Of Having Wife Assaulted To Pay Debts

WARREN, Mich. -- The preliminary hearing for a man accused of having his wife raped to pay off his gambling debts was delayed Tuesday.
Anthony Smith has been charged with two counts of conspiracy to commit first-degree criminal sexual conduct, and one count of conspiracy to commit second-degree criminal sexual conduct. The defense attorney for Smith, Michael Skladd, said that he didn't have all of the information he needed from prosecutors and police. Skladd asked for a delay, and the judge granted it, Local 4 reported.
Police said that Smith set up a home invasion at the couple's home at the Continental Trailer Park, located near Eight Mile and Dequindre roads, in June. A man threatened his 28-year-old wife with a weapon while the husband laid awake next to her in the trailer, police said. The attacker told Smith to put his face down in a pillow, then began to assault his wife, according to police.
After committing three sexual acts on the woman, the attacker told the husband that he owed $5,000, then left without incident, according to Detective David Andrews.
Smith told police that he lost money playing pool six months ago at the Bottoms Up East lounge. His debt reportedly grew to $5,000, according to police.
Andrews said the phony home invasion and rape were intended to pay off some of the debt. The detective said that Smith confessed to the setting up the plot and was remorseful after talking to investigators.
The woman was reportedly unaware of the gambling debt.
Smith's relatives said that he is not capable of arranging to have his wife sexually assaulted to pay off his gambling debts as prosecutors allege. His family said his wife took out a $100,000 life insurance policy a couple of days before the attack.
The suspect's brother, David Smith, said that the family is anxious to get the case over with.
Police are still searching for the alleged attacker. He is described as a black male, between 25 to 30 years old, about 6 feet tall, and weighing about 300 pounds.
Smith is being held on a $1 million bond. The new date for the preliminary hearing has been set for Aug. 7.
