ROYAL OAK, Mich. -- A local family says their mother went in for a routine heart procedure and ended up in worse shape and claim the hospital is to blame.
Rosa Kashat, 74, went to Beaumont Hospital in Royal Oak for a heart catheterization in August 2007.
Nine months later, she is still in that hospital.
Kashat is in and out of consciousness, cannot breathe without a ventilator, and has to eat through a feeding tube, according to her family.
"She has been in the hospital so long. I haven't seen her," said grandaughter Selina Kashat.
Court documents from her family’s lawsuit allege Kashat somehow fell off a table, suffered a head injury and other severe damage while she was at the hospital.
The documents also allege the incident left her bedridden.
Her son, Safa Kashat, said, “She broke her ribs. She broke her hip. And they had to take out her spleen.”
Beaumont Hospital apologized and took responsibility for what happened to Kashat.
The hospital sent Local 4 this statement: “We regret the injury that Mrs. Kashat experienced during her care at our hospital and have assumed responsibility for it, including continuing to care for her at no charge. We also continue to work with the family to meet their needs.”
The Kashats told Local 4 they want more than free medical care.
They want the hospital incident report that details exactly what happened to Rosa Kashat.
Safa Kashat said, "Whoever was in that room, a 74-year-old lady should not go through this. No one should go through this."
Her family hired attorney Geoffrey Fieger, who is working to get that hospital incident report and expects to have it soon.
A court will have to settle the question of whether the case is one of malpractice or neglect.
If it is malpractice, it could be settled with hospital insurance.
If it is neglect, it could be worth millions of dollars.
The first hearing on the Kashats' lawsuit will be later this month.
