DETROIT -- A judge has postponed a hearing for a man accused of kidnapping and raping a teen girl in February.
Jamrul Hussain was scheduled to be in court Thursday for his preliminary examination for allegedly kidnapping and raping a then 14-year-old girl.
The judge set the new date for Nov. 6.
Three defense attorneys for Hussain cited new evidence questioning the teen girl’s credibility for the delay.
“I’m predicting that all charges will be dropped someday,” said attorney John Patrick Smith. “I’m not sure if it will happen on Nov. 6 or if my client will be acquitted of these charges …the main thing is that all this will be corrected.”
The assistant Wayne County prosecutor spoke off the camera to Local 4 after the hearing and said it the new evidence pans out, only the kidnapping and gun-related charge against Hussain could be dropped. He would could still face charges of criminal sexual conduct.
Hussain is also linked to a separate case involving the disappearance of 2-year-old Tangena Hussain. Although he is the missing girl’s mother’s boyfriend, he has no relation to the girl.
The girl has been missing since Oct. 2 and was last seen with Hussain at a gas station in Detroit.
Hussain has said when he returned from being inside the gas station’s store, the girl was gone from his car.
An Amber Alert is in effect for the child.
Hussain's attorney said the teen has accused Hussain of kidnap and rape as a spurned ex-lover.
"It doesn't make sense," said Smith. "The young lady walked into the police station and said 'You got it all wrong. I was with my boyfriend and my father won't let me see this young man again, and we ran away.'"
According to court documents, the girl told police she was kidnapped at gunpoint from her parents' Hamtramck home, driven around for several hours, then held hostage for one week.
In the documents, the girl also told police she was sexually and physically assaulted.
Smith said the girl left home on her own and changed her story two weeks ago after seeing Hussain on the television in the missing 2-year-old case.
"On the news she sees her ex, who had told her he loved her and that they were going to get married, and all this other stuff, and now he's with a new woman," Smith said.
In a statement given to police, the teen said she was not jealous or in love with Hussain. She also stated that Hussain threatened to kill her and her family, and that she would only be allowed to leave if she told police she had run away.
