Man Charged In Freezer Body Case

ME: Cause Of Death Pending

POSTED: Tuesday, September 8, 2009
UPDATED: 2:53 pm EDT September 8, 2009

A 41-year-old man was charged with mutilation of a corpse Tuesday after police said he chopped up a man's body and stuffed it in a freezer.

Daryl Lewis was arraigned in 36th District Court. If convicted, he could face up to ten years in prison. Lewis was also charged as being a second-offense habitual offender, which could increase his sentence by 50 percent.

Lewis was arrested Friday after a woman came to the police station and told police a dismembered body was in the basement of Lewis' mother's home on the 5500 block of Cadiex in Detroit.

Police went to the home around 3 p.m. and found the mutilated body of a 58-year-old man.

Investigators said the victim's hands were cut off and burned before the body was chopped up and placed in several freezer bags.

The victim's identity has not yet been revealed.

An autopsy has been completed, but the cause of death is pending, according the Wayne County Medical Examiner's office.

Prosecutors said more charges could be issued against Lewis once the cause of death is determined.

Police said Lewis admitted to chopping up the body and placing it in a freezer.

However, Lewis told police Friday that he did not kill the man. He said the man was homeless and either died of natural causes or a drug overdose and when he found the dead body, he panicked and didn't know what to do with it, so he tried to conceal the body.

The suspect's attorney Matthew Kolodziejski released a statement Sunday stating his client was innocent.

"The allegations that have surfaced against Mr. Lewis are completely baseless and false," said Kolodziejski. " It seems that it would make sense for the police to be investigating the owner of the home, rather than rushing to judgment and arresting Mr. Lewis for a crime that he did not commit."

Magistrate Sidney Barthwell Jr. set a$200,000 bond for Lewis. Barthwell said the bond was set high for fear of the safety of the people who alerted the police.
