PONTIAC, Mich. -- An Oakland County judge declared a second mistrial Tuesday in the first-degree murder trial of a teenager accused of killing a restaurant manager.
Jerome Hamilton's first trial in the October 2008 shooting death of 21-year-old Catherine Blain was declared a mistrial in August after a jury failed to reach a verdict after about five days of deliberations.
The seven-woman, five-man jury in the Southfield teen's current trial had deliberated for nine days.
Blain, of Waterford Township, was shot dead in the parking lot of the Lathrup Village restaurant where she worked as a night manager.
"Catherine Blain did not get her day in court. She did not," said Linda Sheppard, one of the jurors who wanted to convict Hamilton.
She told Local 4, another juror decided early in the deliberations that Hamilton was not guilty.
"One person seemed to have an agenda," Sheppard said. "We sort of confronted her today. She didn't take notes. She was crocheting. She was just sort of not really paying attention."
Sheppard said two other jurors were also against a guilty verdict, but seemed open to changing.
Prosecutors have said they will seek to put Hamilton on trial a third time.
Blain's father-in-law, Rick Blain, said he was relieved to hear prosecutors will seek a third trial.
He told Local 4 he believed his daughter-in-law was pregnant when she was killed.
"We would have had a grandchild this Christmas and they took that away from us," Rick Blain said.
Brandon Davis, 21, of Southfield is an accused cohort in the killing. He was the prosecution's chief witness in Hamilton's re-trial. He claims that Hamilton pulled the trigger and killed Solinski-Blain.
Defense lawyer Mitch Ribitwer said the reason why both juries had trouble reaching a verdict is because the prosecution's key witness was not credible.
A third person, DeAndre Sturges, 20, of Beverly Hills was also charged with first-degree murder, armed robbery and conspiracy to commit armed robbery. The verdict is sealed because a judge thought the information would taint jurors in Hamilton's case.
