Fatal Crash Suspect Charged With Murder

Police Say Man's Blood-Alcohol Level Five Times Legal Limit

Oakland County prosecutor David Gorcyca announced Thursday afternoon that a man accused of causing a crash that killed a mother and her two sons in Farmington Hills was charged with three counts of murder.

Police said Thomas Keith Wellinger, 48, had a blood-alcohol level of 0.43. Under Michigan law, it is illegal to drive with a blood-alcohol content of 0.08 or more.

Authorities also recovered a black box from Wellinger's sport utility vehicle that revealed he was driving 70 mph in a 45 mph zone when the crash occurred on 12 Mile Road, just east of Orchard Lake Road on Tuesday afternoon.

"The defendant was weaving in and out of traffic," said Gorcyca. "He was tailgating other motorists and he was attempting to pass in the center turn lane and also, according to the black box, never applied his brakes prior to impact."

Judith Weinstein, 49, was driving her Honda to a dentist appointment with her son, Alex, 12, in the front seat and her son, Sam, 9, in the back. Weinstein had just entered a left-turn lane when Wellinger crashed his red SUV into the back of the Honda (pictured, right), pushing the vehicle into oncoming traffic, Local 4 reported.

Judith and Alex Weinstein were pronounced dead at the scene of the crash, the station reported. Sam was ejected from the vehicle upon the impact of the crash. He was taken to a hospital and was later pronounced dead.

The SUV had also crashed into a Ford Jaguar -- which was in the lane next to the Weinsteins' Honda. The SUV then rolled over and struck a Ford Escort, Local 4 reported.

A woman inside the Jaguar and a woman in the Escort both escaped injury in the crash, according to the station's reports.

Wellinger was taken to a hospital with serious injuries, but his condition has been upgraded to fair.

Police are working to develop a timeline of where Wellinger was prior to the crash. Anyone with information is asked to call the Farmington Hills Police Department at (248) 871-2702.

Funeral For Mother, Sons Set For Friday

Gary Weinstein, the victims' husband and father, has turned to the support of family, friends and the family's rabbi, Tamara Kolton, of Birmingham Temple, Local 4 reported.

"All we can do is tell him that he is not alone," said Kolton.

Kolton said Gary Weinstein, who owns Weinstein Jewelers in Novi, and his family were close and spirited.

"This is a tragedy that's outside the proportions that we can even integrate psychologically," said Kolton.

Counselors were on hand at the schools that the Weinstein boys attended in Farmington Hills. Alex Weinstein attended O.E. Dunckel Middle School and Sam was a student at Hillside Elementary.

The funeral for the three victims is scheduled to be held on Friday morning at the Dorfman Chapel in Farmington Hills.
