A judge has dismissed a criminal case against an Ohio man who authorities say lost control of his car and struck a Michigan State Police trooper in 2011.
The Lansing State Journal reports Ingham County Circuit Court Judge Rosemarie Aquilina granted a motion Thursday by Mark Kollar's lawyer to dismiss the case. The 51-year-old from Eastlake was charged with failing to use care while passing a police vehicle causing injury.
Police say Kollar struck Drew Spencer after the trooper stopped another motorist Sept. 4, 2011, on Interstate 96 in Ingham County.

Kollar's lawyer argued a lack of evidence. Kollar says it was "purely an accident" and he has "grieved over it the past two years."
Kollar also faced a misdemeanor charge. Prosecutors will decide later whether to appeal.
