Justice Hathaway to retire, lawyer says, as Tenure Commission seeks suspension in fraud case
According to her lawyer, Michigan Supreme Court Justice Diane Hathaway will retire Jan. 21.
Hathaway has been under the microscope for allegations of fraud and money laundering in connection with real estate she owned in Michigan and Florida.
The Michigan Judicial Tenure Commission on Monday instituted formal proceedings against her, the same day her lawyer said Hathaway would be retiring by the end of the month.
Attorney Steve Fishman tells The Associated Press that Hathaway filed the paperwork on Dec. 20.
Fishman says the Judicial Tenure Commission was told about Hathaway's retirement in December. He says the filing of the 19-page complaint was a "gratuitous" move.
Hathaway has agreed not to participate in any matters before the court, including this week's oral arguments, a Michigan Supreme Court spokeswoman said.
