Marcia McBrien says Hathaway sent an email to court staff and other justices knocking down speculation that she's resigning.
Records show some properties were put in relatives' names while she and her husband were persuading a bank to allow a short sale on a home in Grosse Pointe Park. Chief Justice Robert Young Jr. has urged Hathaway to "clear the air" on the matter, but she won't comment.
Hathaway attorney Steve Fishman won't comment on reports that the FBI is looking at the transactions. He's said there's nothing "underhanded."
