US court: Officer immune from ex-prisoner suit
John Stahl was arrested in 2008 after Romulus had a series of break-ins
Despite more than four months in jail, a man wrongly arrested for home break-ins in western Wayne County can't sue the officer who made the case against him.
A federal appeals court last week said Romulus police Detective Phil Czernick has some immunity because there was probable cause to arrest John Stahl.
Stahl was arrested in 2008 after Romulus had a series of break-ins. Two witnesses identified him as a man going door-to-door seeking to perform odd jobs. But one witness couldn't identify him as the suspect.
Stahl says his rights were violated because the detective failed to include some inconsistencies in the arrest warrant.
Although someone later confessed to the crimes, the appeals court says the detective shouldn't be liable because two witnesses did identify Stahl.
