Eminem's ex-wife says case was sealed because of medical information

DETROIT – Eminem's ex-wife Kim Mathers called into a Detroit radio station this week to offer an explanation of her arrest for an alleged drunken driving crash. 

Mathers told "Mojo in the Morning" show hosts that she did not expect to survive the Oct. 7, 2015 crash at 21 Mile and Card roads in Macomb County. She admitted it was a suicide attempt.

"I sat at the end of a road where I knew that no one else but myself would get hurt. Yes, I drank, I took pills and I hit the gas and aimed for a pole," Mathers said.

Her Cadillac Escalade was found in a ditch. She told the radio hosts she did it on purpose and she is sorry. 

"I apologized immensely. I did not even expect to make it through that, and I told (police) that I tried to do this on purpose. I'm so sorry," she said. 

The case was sealed, unlike the average drunken driving case. Local 4 was first to report the case last week and has obtained a portion of the court documents. Mathers told the radio station the only reason the files were sealed was because this was a suicide attempt.

"They knew that those records were sealed. There was medical information in them. It had nothing to do with the rest of the case," she said. 

Mathers' attorney said she wasn't in the right state of mind, the warrant wasn't written properly and the judge didn't have the proper authority.

“Everything has merit. I totally believe in the case, I totally believe in my argument. We'll see how it plays out,” said attorney Mike Smith.

The prosecution sees things differently. In a separate filing there are numerous reasons and arguments laid out saying consent was freely given and she was not incapacitated.

Judge Douglas Shepard will hear both arguments later in May.

The court file also says Mathers broke her wrist and toes in the crash. She also had a concussion and bruises.  The documents show she spent five days in the hospital.
