How did it come to this? A million-dollar, 9,000-square-foot Washington Township home seems destined to either be moved from its lot or the victim of a wrecking ball.

Why? All of 32 feet.

When Simon Palushaj bought the lot in 2004 he had no clue there were deed restrictions and didn’t find out until he was served. He was sued by his next-door neighbor after the foundation and building had already started.

Turns out Palushaj’s home is 20 feet to close to that neighbor’s home, on the other side he’s 12 feet too close to the other home. Nine years later and legal battle after legal battle Palushaj now had two options: find a way to move the home to a new lot, or bulldoze the million dollar home and salvage what he can.

"It’s been a long battle, I never thought it would come to this," Palushaj said.

After mediation and settlement offers went nowhere, it’s now down to the two options.

He's hoping a Macomb County judge will give him some more time to coordinate an attempt to move the home.

The neighbor suing Palushaj lives out of state most of the year and isn’t in state at this time. I asked Palushaj if he had to do it all over again what does he wish, his answer quick and simple: "I wish I’d known more about deed restrictions."
