Jury: Man not guilty of shooting federal judge outside Detroit home

DETROIT – A jury has found a man not guilty of armed robbery and assault with intent to murder in the shooting of a federal judge outside a home in Detroit's University District.

Kevin Smith, 23, was charged with shooting Judge Terrence Berg outside Berg's home on Oak Drive in March 2015.

Berg testified that Smith asked to be let into the home, but when he refused to let Smith and another man in, Smith shot him in the right leg. Berg recovered from the gunshot wound.

Smith was charged with armed robbery, conspiracy to commit armed robbery, assault with intent to murder, using a firearm to commit a felony and being a felon in possession of a gun.

On Tuesday, the jury found him not guilty of the armed robbery and assault with intent to murder charges, but guilty of conspiracy to commit armed robbery and two felony firearms charges.

The second man involved in the shooting acted as a cooperating witness and has not been identified by the prosecutor's office.

Smith also is charged in a string of separate robberies. 

Berg lives in Detroit but works at the federal courthouse in Flint.Â
