Hearing for Wayne County judge continues Tuesday after being suspended for affair
Wade McCree admits to having sex in chambers with woman involved in child support case
Testimonies continue in the hearing of a judge who a state agency says had an affair with a woman who had a child-support case pending in his court.
The Michigan Judicial Tenure Commission hearing for Wayne County Circuit Judge Wade McCree began Monday in Ann Arbor and is expected to last several days. A retired judge is presiding.
McCree is fighting for his career in court, along the way he has said, "There is no shame in his game." The state hearings officer disagrees.
"The respondent may not think there is no shame in his game, but the facts and the witnesses in this case will show that he shamed the bench, he shamed the legal profession, he violated the code of the judicial conduct and he broke the law," said Margaret Rynier from the Judicial Tenure Commission.
Wayne County Prosecutor, Kim Worthy was drawn into the sorted court proceeding to testify.
"He said that he had been a bad boy," Worthy said in court. Watch: Judge Wade McCree fighting for career in court
Geniene La'Shay Mott disclosed an affair with McCree in December. He was placed on leave and then suspended without pay in February.
McCree denied being the father and told Worthy La'Shay was extorting and harassing him. Investigator say there is no evidence to support his claim.
An obviously pregnant La'Shay took the stand Monday to testify in court. She revealed salacious details of her alleged affair with the judge. La'Shay says McCree was shocked to learn she was carrying his child and he waivered on the course of action to take while contemplating divorce and even abortion.
"He asked me what I was going to do and if this was what I really wanted, other times he pushed for termination and between he said whatever I did, he would support me," said La'Shay.
During Monday's testimony the prosecuting attorney asked Mott when she thought she became pregnant by McCree.
Mott: I don't have to give out those details.
Prosecutor: Yes you do.
Mott: Well, the date of which I became pregnant was, that's a medical question. I'm not sure of the date I became pregnant.
Prosecutor: When did you tell him?
Mott: I told him at the beginning of November.
Prosecutor: You told him AFTER you told him the relationship was over, didn't you?
Mott: He never told that to me.
Prosecutor: Do you remember a confrontation with Judge McMcree - well, let's not call it a confrontation - do you remember scheduling a meeting with Judge McCree at your house on October 30th where you scratched him?
Mott: I'm not sure of the date but I never scratched him except during sex.
Prosecutor: Are you pregnant now?
Mott: I'll let you be the judge of that.
Prosecutor: Well, I want an answer to my question. Are you pregnant now?
Mott: Yes I am.
Prosecutor: You're not pregnant with Judge McCree's child?
Mott: I'm not answering any questions related to my pregnancy.
RAW: Woman at center of Wade McCree controversy testifies
The commission says McCree lied during the agency's ethics investigation and falsely reported to prosecutors that Mott was stalking him.
A heated exchange broke out during the proceedings when Mott refused to answer whether McCree is the father of her baby. The prosecutor argued the line of questioning was not relevant. The defense demanded it be deemed relevant. "The reason it is relevant your honor is because we're talking about this woman's credibility. If she is telling him 'You either pay me or else' and these are threats that she's not pregnant that is a reason for him to go to the prosecutor...so it is very relevant."
Mott also testified she and McCree bought a house together - but his name was not on the deed.

McCree's attorney, Brian Einhorn, has said the judge shouldn't lose his job.
The state Supreme Court reprimanded McCree last year after he sent a shirtless photo of himself to a female court employee.
