PONTIAC, Mich. -

The pre-trial is Thursday for a lawsuit against a website that allegedly sold Pavel Datsyuk merchandise without the hockey player's permission and without sharing any of the profit with him.

PashaSportsWear.com, which is now defunct, is accused of selling clothing with the Detroit Red Wings star's No. 13 on it.

"Despite continued and best efforts to amicably resolve the matter, the lawsuit was brought to address continued infringement of Mr. Datsyuk's name and celebrity and to prevent continued deception of the public," said an attorney representing Datsyuk.

The lawsuit has asked a judge to keep the website down while deciding whether the merchandise is authorized.

A trial date is scheduled for Sept. 9.
