DETROIT – A lawsuit, which was filed in April over Eminem's song "Under the Influence" being used during an advertising campaign on Facebook in April has a scheduled court date Monday. Eight Mile Style, the music publisher for

Eminem (whose real name is Marshall Mathers), claims Facebook's advertising agency (Wieden + Kennedy) used the song during YouTube and television ads without consent.

It alleges Facebook founder Mark Zuckerberg used "Under the Influence" during a press conference when he unveiled "Facebook Home".

Clips from that event were then distributed on air and online.

The lawsuit also claims the ad agency changed revised the music after realizing it had infringed on the copyright of Eight Mile Style.

The lawsuit doesn't ask for any specific damage but requests Facebook and Wieden + Kennedy to pay any and all legal fees.

Monday's court date is for a final pretrial in the case.
