Judge Gorcyca accused of misconduct in Oakland County custody case

A two-count complaint from the Judicial Tenure Commission accuses Judge Lisa Gorcyca of misconduct in her handling of a custody case involving the minor children of Maya and Omer Tsimhoni. 

Gorcyca orderd the three children to juvenile detention for refusing to have lunch with their father. The complaint says Gorcyca "failed to act in a dignified and courteous manner" and made misrepresentations of law and fact. 

According to the complaint, the oldest child told Gorcyca he did not want to speak to his father because he believed the father was violent, having witnessed him hit the boy's mother. Gorcyca told the boy: "I ordered you to have a healthy relationship with your father. The court finds you in contempt." She had deputies handcuff the boy.

During the 13-year-old's contempt hearing, according to the complaint Gorcyca told the boy: He would live in Children's Village. She doubted he has a high IQ. He has no manners and was mentally messed up. He should research Charlie Manson and his cult because he had been brainwashed.

Gorcyca also conducted a contempt hearing for the 9-year-old child. According to the complaint, she told the child at that hearing:

"You have a brain. You are not your big defiant brother, who is living in jail. Do you want to live in jail? Do you want to have your birthdays in Children's Village? Do you like going to the bathroom in front of people?"

An attorney for Gorcyca released this statement:

"We are extremely disappointed that the Judicial Tenure Commission decided to proceed with a complaint but we are looking forward to telling the whole story of this tragic case at a formal hearing. In the end, we are confident Judge Gorcyca will be fully vindicated and that the complaint against her will be dismissed."
