When a crash upends a life, the hours and days before a lawsuit is filed often determine how strong that case will be, said David Femminineo, managing partner at Femminineo Law.
“What happens between the date of the accident and the time that you file the lawsuit is so critical to the success of that lawsuit,” Femminineo said during an appearance on Live in the D. “Getting you paid starts on day one of the case when you’re involved in an accident.”
Femminineo said the firm’s Accident Response Team is designed to move immediately, pairing clients with crisis counselors, coordinating with medical experts and locking down technical evidence before it disappears.
“We take a super aggressive approach,” he said. “We have crisis counselors who help you right off the bat. We have medical experts who will talk to your doctors and make sure you’re getting the care that you need to move forward with your life. We also have technical experts who make sure that we preserve that video evidence, we preserve the audio, we preserve the video of the area of the scene of the accident itself.”
Speed matters, he added, because key data can be lost within days. “Evidence disappears, and it disappears very, very quickly,” Femminineo said, pointing to vehicle “black box” data and wrecked cars slated for the scrapyard. “We need to make sure that we lock down that evidence before it disappears.”
For clients, the immediate effect is relief, he said. “What changes is that they feel as though they can go about their life and rest and heal while we take care of all the legalities,” Femminineo said. “All you need to do after an accident is rest and heal.”
The goal, he said, is to let clients focus on recovery while the firm builds the case behind the scenes. “We have a team of experts that are ready to help and ready to move forward on your case immediately so that you can go about your life and try to pick up the pieces after an accident,” Femminineo said.
