Jason Schultz, 28, had his tow truck on the southbound lane of traffic on North Road, south of Keewahdin, at about 6:30 a.m. on Jan. 15 while he was attempting to pull a vehicle from the ditch on the west side of the road.

Sheldon was behind the wheel of a Jeep when he passed the truck on the shoulder and hit Schultz, the St. Clair County Sheriff's Office said. The driver of the vehicle getting pulled out of the ditch was in his vehicle and was also struck. He has since been released from the hospital.

Toxicology reports from the Michigan State Police crime laboratory showed that Sheldon had marijuana in his system at the time of the crash, the sheriff's office said.
