Detroit woman arraigned on OWI charges after crossing guard hit outside school in Roseville

ROSEVILLE, Mich. – A Detroit woman was arraigned Wednesday on charges in connection with an 82-year-old crossing guard who was run over outside an elementary school in Roseville.

Nichole Drain, 36, was charged with felony third-offense operating while intoxicated, misdemeanor operating while intoxicated, operating with a suspended license, failure to stop at the scene of a personal injury accident and open container of alcohol in a vehicle.

Authorities said the incident happened at about 3 p.m. Tuesday outside Steenland Elementary School.

Albert Lipinski works as a crossing guard at the school so he can walk his granddaughter to and from school.

On Tuesday, a woman was driving erratically and blocking the intersection in front of the school by trying to do a U-turn, so Lipinski told her she needed to move.

That's when she hit him with her car, police said.

"I saw her drive away, and I didn't know where she was going," Lipinski said. "I thought she was just going to turn around."

The woman didn't drive back, but when she returned on foot about 10 minutes later, parents said she created a scene.

"She was telling everybody I jumped in front of her car," Lipinski said. "She was cussing everybody out."

Police said alcohol was the problem, and they took the woman into custody.

"It's kind of eerie to be on the ground looking up at a bumper," Lipinski said.

Lipinski refused medical treatment at the scene, but the school principal prevailed on him to go get checked out. He's banged up, but nothing is broken.

Lipinski said he will return to work Wednesday.

Drain's bond was set at $50,000 cash/surety, no 10 percent. She is due back in court Oct. 25.
