A notorious 1979 missing-child case will go to trial for a third time in New York City.

Lawyers for a man whose conviction in the 1979 disappearance of 6-year-old Etan Patz was recently overturned asked a judge on Tuesday to set a date for his release from prison if prosecutors don’t decide soon to hold a new trial.

Prosecutors say they may appeal to the U.S. Supreme Court to try to restore a murder conviction in the 1979 disappearance of 6-year-old Etan Patz.

The 1979 disappearance of Etan Patz was one of the nation’s most notorious missing child cases.

A federal appeals court has overturned the conviction of the man who was found guilty in 2017 of killing 6-year-old Etan Patz in 1979.
