Oakland County couple faces first-degree child abuse charges after 4-year-old has bones broken

A conviction for first-degree child abuse carries up to life in prison

OAKLAND COUNTY, Mich. – Rochester Hills mother, Kimberly Ann McGarry, 26, and boyfriend Cleyde Murillo, 29, are in the Oakland County Jail on first-degree child abuse charges stemming from injuries suffered by the mother’s 4-year-old daughter.

McGarry was arraigned on Thursday, July 24, 2025, in 52-3 District Court in Rochester Hills, where bond was set at $150,000 with a 10% provision, which would allow her release after posting $15,000.

She was arrested on Tuesday near Grand Rapids by U.S. Marshals.

Murillo was arraigned on July 14, where bond was set at $750,000 with the 10% provision, which allows his release after posting $75,000.

He was arrested on July 11 in Muskegon County, where he had gone for a supervised visit with his daughter.

Sheriff’s detectives became aware of the case on Dec. 26, 2024, after they were notified by child protective services.

McGarry’s daughter had been taken to the hospital on Dec. 21, where doctors determined she had a broken left leg and a broken right arm, which were in different stages of healing.

McGarry told doctors the injury happened at the home in the 46000 block of Dequindre Road she shared with Murillo.

The mother said her daughter had fallen down the steps two weeks earlier.

Doctors later notified CPS as the injuries were not consistent with McGarry’s statement.

Officials said McGarry later gave conflicting versions to detectives about how the injuries happened.

McGarry confirmed during an interview that the injury took place on Nov. 15, and neither she nor Murillo provided any medical attention for the 4-year-old girl, potentially causing permanent injury to her.

The mother has two other children, a 6-year-old daughter and a 9-year-old son, both of whom are now living with their biological father.

The Oakland County Prosecutor’s Office issued charges against the couple on July 10.
