Duo face possibility of life in prison on child abuse charge

ROCHESTER HILLS, Mich. – A 4-year-old girl might have permanent injuries after an Oakland County mother lied about her broken bones, police said.

A 4-year-old girl was brought to the hospital on Dec. 21, 2024, with a broken left leg and a broken right arm, according to the Oakland County Sheriff’s Office.

Doctors said the two broken bones were in different stages of healing.

The girl’s mother, Kimberly Ann McGarry, told doctors that her daughter had fallen down the stairs two weeks prior at their home in the 46000 block of Dequindre Road in Rochester Hills.

Conflicting stories about injuries

Doctors called Child Protective Services because they didn’t think the girl’s injuries matched McGarry’s explanation. CPS called deputies on Dec. 26.

When McGarry spoke with detectives, they said she gave conflicting stories about her daughter’s injuries.

She told them the injuries happened on Nov. 15, 2025, and that neither she nor her boyfriend, Cleyde Murillo, had given the girl any medical attention.

Police said this might have caused permanent injury to the girl.

“There can be no excuse and no tolerance for anyone who abuses a child,” Oakland County Sheriff Michael Bouchard said. “It is one of the more heinous crimes we encounter, and I am anxious for these suspects to be held accountable.”

Charges for mother, boyfriend

McGarry, 26, was arrested Tuesday near Grand Rapids by United States Marshals. Murillo, 29, was arrested July 11 in Muskegon County, where he had gone for a supervised visit with his daughter, police said.

They were both brought to the Oakland County Jail. Police said they lived together at the home on Dequindre Road.

The pair were charged July 10 with first-degree child abuse, which carries a maximum sentence of life in prison.

McGarry was arraigned Thursday at 52-3 District Court in Rochester Hills and given a $150,000 bond, or 10%.

Murillo was arraigned July 14 and given a $750,000 bond, or 10%.

McGarry also has a 6-year-old daughter and a 9-year-old son. Both are now living with their biological father, police said.
