Lawsuit claims city of Warren denied patients medical marijuana access

WARREN, Mich. – A lawsuit against the city of Warren claims the city has denied Michigan Medical Marihuana Act (MMMA) patients and caregivers access to their medicine.

Attorney Michael Greiner held a news conference Monday afternoon to discuss this lawsuit.

"They have been subjected to repeated harassment by the city of Warren," he said. "They have actually been unlawfully detained. No charges have ever been brought against them because they're not violating the law."

Twenty-three individual plaintiffs and two LLCs -- a dispensary -- are named in the lawsuit. Greiner claims the city of Warren -- from the mayor down -- doesn't want medical marijuana in the city. He said they have raided the dispensary, scaring customers away.

"Essentially there has been an attitude among city administrators that they don't want medical marijuana to come to the city despite what state law says," said Greiner.

Mayor Jim Fouts told Local 4 he is unaware of any harassment. He said the city isn't targeting anyone and that he respects the state law and medical marijuana. Fouts said he is working on a medical marijuana ordinance that would move facilities like this one to industrial neighborhoods because of the odor.

Here is the criminal complaint, which was submitted on Monday:
