Judge testifies about shooting outside Detroit home

Judge Terrence Berg shot in leg last year outside University District home

DETROIT – The trial of a man accused of shooting and wounding a federal judge outside his home got underway on Tuesday. 

Kevin Smith, 23, and another man are accused of confronting Judge Terrence Berg outside Berg's University District home in March 2015.

Smith told Berg to let them into his home, but when Berg refused to let them in, Smith shot him in the right leg, according to the prosecutor's office.

Berg recovered from the gunshot wound.

Smith is charged with armed robbery, conspiracy to commit armed robbery, assault with intent to murder, using a firearm to commit a felony and being a felon in possession of a gun.

The other man is acting as a cooperating witness and has not been identified by the prosecutor's office. Smith is also charged in a string of robberies. 

Berg lives in Detroit but works at the federal courthouse in Flint.
