GROSSE POINTE PARK, Mich. - Despite maintaining that Bob Bashara did not kill his wife, defense attorney David Griem told the Local 4 Defenders charges might be coming.
"Based upon the evidence that we know of, as we're sitting here today, he should not be charged," Griem said, during an interview Thursday. "But I would not be surprised if he's charged. If he is charged, my best guess is that it would be an open charge of murder."
When asked if he thought the murder charge would be issued soon, Griem said, "I hope and pray not."
Bashara's 56-year-old wife, Grosse Pointe Park mother Jane Bashara, was found dead Jan. 25 in the back of her SUV, which was parked in an alley on Detroit's east side.
Bob Bashara has been pegged a person of interest in his wife's murder, but has not been charged. Sources said Bob Bashara failed a previous polygraph that he had been given last Friday by police.
Griem, said the second polygraph was privately administered on Wednesday.
"They key questions in that polygraph were, ‘Did you kill your wife?' and, ‘Did you have anything to do with the death of your wife,'" Griem said. "In talking to the polygraph examiner early last evening, it's his opinion that Mr. Bashara had no role in either."
When asked about the inconsistency between the two reported polygraphs, Griem said, "So much depends on the pre-test interview, so much depends on the way the questions are worded. And, again, right now, I'll say that if we want to have a battle of polygraphs examiners, let them bring it on."

On Wednesday, Bashara stood with his mother and son as he spoke to the media outside his home.
"This is an unconceivable tragedy," he said.
Wiping away tears, he said the family had cooperated with law enforcement agencies and would continue to.
"In the light of this horrific event, we ask for your continued prayers, ask for your support and respect of our privacy as we deal with this heartbreak and try to cope," Bob Bashara said.
