DETROIT – The United States District Court in the Eastern District of Michigan Southern Division denied former Detroit Mayor Kwame M. Kilpatrick’s motions to modify or terminate restitution and to strike and object to continuing garnishment.
An amended judgment was imposed against Kilpatrick in criminal case No. 10-20403 for $1,718,457.11 on Monday (Feb. 2).

The government has been enforcing this judgment through miscellaneous case No. 22-51143.
In December 2025, the government filed several applications for writs of continuing garnishment.
Kilpatrick responded with a motion to modify or terminate restitution in the criminal case and a motion to strike and object to the continuation of garnishment in the miscellaneous case.
Both motions argued that his restitution balance should be considered satisfied in full.
However, the court approved and issued, under seal, a stipulated agreement for a final order of continuing garnishment to the Michigan Legislative Retirement System in the miscellaneous case.
The court also approved a sealed stipulated payment plan order in the criminal case.
The orders were filed under seal due to sensitive financial information protected under the Right to Financial Privacy Act of 1978 and the Privacy Act of 1974.
In the stipulated orders, the parties agreed that the total balance due on the judgment as of Jan. 27, 2026, is $823,649.09.
Kilpatrick waived his right to a hearing under the Federal Debt Collection Procedures Act and agreed that his pension benefits and other income are subject to garnishment.
Accordingly, the court denied Kilpatrick’s motions as moot.
