FLINT, MI—The Michigan Court of Appeals has denied a request by the Michigan Attorney General’s Office to reverse a previous decision made by a Genesee County Circuit Court judge in a case stemming from the Flint water crisis they say could cost taxpayers millions of dollars and could delay nine pending criminal cases for years. In a statement emailed to MLive-The Flint Journal Thursday, Ron DeWaard, a lawyer for Lyon, said he welcomes the ruling. “SG Hammoud and her team need to hire a taint team to get on with this privilege review forthwith,” the statement begins. “They have delayed even identifying a taint team or creating a review protocol for far too long. In March, Kelly told the AG’s office to continue working on forming a taint team but allowed a pause while awaiting the Michigan Court of Appeals ruling on her actions.

Expungement fair offers ‘second chance’ to more than 700 people in Genesee County

FLINT, MI — Nearly 1,000 Genesee County residents had the opportunity to wipe their criminal record at an expungement fair held on the lawn of the Genesee County Jail Wednesday. FLINT, MI -- The city’s former Department of Public Works director is asking a Genesee District Court judge to reconsider recusing himself from the criminal Flint water crisis case against him and is using the words of a lead prosecutor to bolster his case. Michigan officials on Thursday announced the outcome of the criminal investigation into the Flint water crisis. Former Governor Rick Snyder is facing two counts of willful neglect of duty for "failing to protect the health and safety" of the city's residents. "Today's charges do nothing to bring justice to the people of Flint," Lennon said. Flint criminal cases will wrap up early next year, says Michigan AG Nessel

The Flint criminal cases involving the city’s water crisis will be wrapped up in early 2021, according to Michigan Attorney General Dana Nessel, who made the announcement at a Dec. 22 press conference. The Flint criminal cases, led by Michigan Solicitor General Fadwa Hammoud, were expected to be finished by the end of this year but the pandemic stalled progress, according to Nessel. “Several members of the Flint team were down with COVID-19 so it prevented them from wrapping things up this year,” Nessel said. “I’m really proud of our office,” Nessel said. Once cases are found to meet the legal standard of wrongful conviction, the Act ensures exonerees are provided appropriate compensation for the harm they suffered. These cases are complex and weave together the skill sets of criminal prosecution, criminal defense and civil litigation to ultimately decide whether or not an individual is entitled to compensation, Nessel said. A protocol was also established by Nessel to ensure all claims undergo a thorough and systematic assessment before any decision is rendered.

Hammoud and Worthy address Flints frustrated residents

Michigan Solicitor General Fadwa Hammoud and Wayne County Prosecutor Kym Worthy address frustrated residents at a UAW hall in Flint. Residents were given a chance to speak directly to Hammoud and Worthy and voiced their concern over the investigations revamp. Many of these residents appeared shocked and frustrated over the decision to drop charges and extend the investigation beyond its three years under the previous administration. Residents had mixed reactions to the presentation, with some expressing support and others doubt over the new investigative efforts. Many were frustrated when the moderator told the audience the meeting had gone over time and needed to end.

She and Hammoud maintain the former team under then Attorney General Bill Schuette only collected a sliver of the relevant evidence. Examples they gave include the prior team getting warrants for five cellphones or other electronic devices. Worthy and Hammoud did not promise prosecutions; what they did promise is to go where the evidence takes them.
