DETROIT, MI -- Officers who shot and killed a 20-year-old man when he charged at them with a knife were justified in their actions, Wayne County Prosecutor Kym Worthy ruled. Detroit officers fired 38 shots in three seconds as Porter Burks ran toward them in the early morning hours of Oct. 2. “Officers repeatedly warned Mr. Burks to keep his distance prior to his running, then ordered him to stop and drop the knife. Given how rapidly Mr. Burks was charging toward the police while armed with a knife, the decision to shoot Mr. Burks was justified,” Worthy wrote in an opinion. Burks’ family has filed a $50 million wrongful death lawsuit against the City of Detroit and five police officers.

The family of Porter Burks, 22, told police that Burks was in a mental health crisis and he was armed with a knife. Officers found Burks in the area of Snowden near Lyndon, standing in the middle of a street. The video, shown by police during a press conference Tuesday, Oct. 4, shows officers approach Burks and offer him help. The officer were trying to negotiate with him and, without provocation, he charged the officer(s) with a knife in hand,” White said.
