Videoed child abuse testimony may soon be the standard under House bills
In an effort to keep children from being retraumatized, prosecutors would be required to video record statements from child abuse or neglect victims to use in court under a trio of bills before the House Judiciary Committee. House Bill 6290, House Bill 6291 and House Bill 6292 would collectively work to allow a video recorded statement to be admissible as evidence at trial, and also admissible at a preliminary examination, from a child abuse or criminal sexual conduct victim under 16 years of age. Rep. Jeff Yaroch, R-Richmond, in testimony said these bills are a reintroduction of bills from the prior session which died in the Senate after objections from Macomb County Prosecutor Eric Smith. “So, therefore, we’re bringing it back.”Under the package, an interview of a child conducted in a child assessment center for a child abuse or neglect investigation would be required to be recorded. Should that occur, the bills would be sent to the chamber floor for an eventual vote by the full House.

According to the Associated Press, Oakland County Circuit Judge Nanci Grant issued the ruling after a request was made by Michigan Attorney General’s Office that pensions for Smith and his former chief of operations, Derek Miller be frozen. Grant is handling the case as the judges in Macomb County disqualified themselves. Smith is facing 10 charges in that case, while Miller is facing two. The pensions, which are through the Macomb County Employees Retirement System, or MCERS, will be frozen until further ruling from Grant.

In a federal case, he pleaded guilty last year to attempting to get three people, including two assistant prosecutors, to make false statements about his use of campaign cash. Between 2012 and 2020, Smith conducted two fraud schemes to steal approximately $75,000 in cash from his political campaign for personal expenses, federal investigators said. Federal prosecutors are seeking 21 months in prison.

A federal judge says the IRS can't keep withholding coronavirus relief payments from incarcerated people, potentially clearing the way for at least 80,000 checks totaling more than $100 million to be sent to people behind bars across the United States. The legislation passed in March that authorized the payments of up to $1,200 per person during the pandemic doesn't specifically exclude jail or prison inmates. Still, that's exactly the claim that the IRS made a couple of weeks after the coronavirus rescue package passed. Prison officials in Maryland and California are working to notify all lock-up facilities. Some inmates may be reluctant to apply even if they hear about the ruling in time, Dermody said.

In addition, federal court said he developed a scheme with Macomb County Assistant Prosecutor Paul Bukowski to set up a fake consulting company contact to justify $20,000 in campaign money he stole. “It was clear it was more than misappropriation of funds it was.” said Macomb County Commissioner. Drolet along with county executive and treasurer Larry Rocca raised the alarm in 2018 over Smith’s handling of county asset forfeiture money.

Former Macomb County prosecutor Eric Smith is no stranger to a courtroom, but Friday he was just another defendant. United States Attorney Matthew Schneider said the FBI had been investigating Smith for more than a year. “Our state has seen a number of public officials who have sworn to uphold their oaths and then they violated that,” Schneider said. Smith was given a $10,000 unsecured bond, he can’t leave the state without approval and has to surrender his CPL. He faces up to 21 months in custody and a $250,000 dollar fine.

Former Macomb County assistant prosecutor reaches plea deal in alleged embezzlement scheme
LANSING, MI – A former Macomb County official charged with multiple felonies has taken a plea deal. Benjamin Liston, former Macomb County chief assistant prosecutor, pleaded guilty to three counts of willful neglect of duty by a public officer holding public trust on Thursday during a remote hearing in Macomb County court before Judge Cynthia M. Arvant. He will also be required to cooperate in the ongoing prosecution of Macomb County Prosecutor Eric Smith and other remaining defendants in the case. Charges were filed in March against Liston along with Smith, then-current Macomb County Assistant Prosecutor and Chief of Operations Derek Miller, and businessman William Weber. Liston worked as chief assistant prosecutor for Macomb County between January 2005 and February 2018.

However, investigators found Smith had four accounts containing public monies he controlled without official county oversight. WARREN, Mich. Two 16-year-old boys have been charged with assault in connection to hazing in the De La Salle High School football program. De La Salle forfeited its high school playoff game due to allegations of hazing in the team locker room. Warren police will present their findings to the Macomb County Prosecutors Office and recommend charges against three students, Dwyer said. The three students in question have been suspended since the start of the investigation, Dwyer said. Local 4 reached out to De La Salle High School for comment, but school officials said they dont comment publicly about disciplinary matters.

It happened at Bumpers Landing on North River Road in Harrison Township. The security footage captured a man trying to get a drink and being turned down. The man begins an altercation with staff and security, and that's when Shafer put himself between them and deescalated the situation. Clinton Township mother dies after 'horrendous beating' at hands of daughter, officials say
CLINTON TOWNSHIP, Mich. - A Clinton Township woman has died weeks after a "horrendous beating" at the hands of her daughter left her on a ventilator with several broken bones and a brain bleed, officials said. Ann Marie Walsh, of Clinton Township, was arraigned Aug. 16 on a charge of first-degree vulnerable adult abuse for allegedly neglecting, mistreating and abusing her mother, police said. Clinton Township police said they were called Aug. 8 to a hospital due to concerns about a severely injured woman. The woman was in unstable condition, incapacitated on a ventilator and had a brain bleed and numerous broken bones, officials said. Police said Walsh and her mother were inside their Clinton Township apartment when the attack happened.

MACOMB COUNTY, Mich. - The Michigan Court of Appeals ruled Thursday that a Macomb County man convicted of raping a 12-year-old girl won't get parole. Richard McBrayer was convicted in 1994 of two counts of first-degree criminal sexual conduct and sentenced to 20-40 years in prison. McBrayer, 61, was 36 years old when he pleaded guilty to raping the child multiple times over two years. Macomb County Prosecutor Eric Smith filed an emergency motion to appeal the decision. Smith also appealed McBrayer's parole in 2011 and 2013.

William Brown is accused of riding his bicycle around Dodge Park trail Aug. 1 while exposing himself and masturbating, police said. An off-duty police officer said she was jogging on the asphalt trail when she saw Brown with no grip on the handlebars. About a half-hour later, another woman saw Brown on his bicycle exposing himself and tried to go in a different direction, according to authorities. Brian Kozlowski's estranged wife "felt tired, nauseous and was experiencing blurred vision" on July 2018 after drinking coffee that Kozlowski had prepared for her, the Macomb County Prosecutor's press release states. Videos later revealed Kozlowski had been pouring diphenhydramine, the active drug in Benadryl, "into his wife's morning coffee, intentionally poisoning her," the release states. The last coffee he made was analyzed and found to contain 127 milliliters of diphenhydramine, the release said. The couple is now divorced, according to the Macomb County Court site.

The last coffee Kozlowski made her contained 127 milliliters of diphenhydramine, experts said. He was given 60 days in jail to be served on weekends and five years of probation, officials said. Probation is substantially below the sentencing guidelines for poisoning, a 15-year felony, Macomb County Prosecutor Eric Smith said.
